Lexicon bowel drug meets main goal of mid-stage trial, shares rise

(Reuters) - Lexicon Pharmaceuticals Inc said its experimental bowel disorder drug met the main goal of reducing bowel movements in patients with gastrointestinal cancer in a mid-stage study, sending its shares up as much as 13 percent on Friday.

The drug telotristat etiprate is being studied to treat carcinoid syndrome, a secondary condition that develops in patients with tumors in the gastrointestinal tract.

Of the 15 patients enrolled in the study, 75 percent reported improvement in carcinoid symptoms at week 12 of the trial. The study also met the secondary goals of reducing abdominal pain and improving stool consistency.

The drug was tested on patients who were unable to tolerate somatostatin analog therapy -- the current treatment for carcinoid syndrome.

However, Morningstar analyst Karen Andersen said the drug could now be potentially used as a first-line therapy.

"Based on the data today I thought it looked like an extremely safe option ... and the efficacy was actually quite impressive. It's looking like a really promising orphan drug," Morningstar's Andersen said.

The U.S. Food and Drug Administration had granted the drug an orphan drug designation in March.

Wedbush Securities Inc analyst Liana Moussatos said the company could file with the FDA for marketing approval in the middle of 2014.

Telotristat etiprate is also being studied in a mid-stage trial to treat ulcerative colitis, a type of inflammatory bowel disease.

Lexicon is expected to start late-stage trials of its diabetes drug -- its most advanced drug candidate -- in the first half of 2013.

The company is also testing drugs for irritable bowel syndrome, rheumatoid arthritis and glaucoma.

The Texas-based biopharmaceutical company's shares were up 8 percent at $2.59 on Friday on the Nasdaq.

Fly genomes show natural selection and return to Africa

When ancestral humans walked out of Africa tens of thousands of years ago, Drosophila melanogaster fruit flies came along with them. Now the fruit flies, widely used for genetics research, are returning to Africa and establishing new populations alongside flies that never left ? offering new insights into the forces that shape genetic variation.

That's one of the findings from two new papers published this month by researchers at the University of California, Davis, and their colleagues that describe the genomes of almost 200 strains of the tiny flies.

The work reveals strong evidence of pervasive natural selection throughout the D. melanogaster genome, said Charles Langley, professor of genetics in the Department of Evolution and Ecology at UC Davis and an author on both papers. That is in striking contrast with what is known of the human genome, which shows comparatively little evidence of adaptation over the last 100,000 years.

The overall aim of the research is to better understand the forces that shape genetic variation, Langley said. Human geneticists are working to sequence a thousand human genomes to get at the same issue. The knowledge from studying fly genetics has and will help in that effort, he said.

"Most of the theory and statistical methods in human genetics were originally motivated by studies of flies, because they're easier and faster to work with," Langley said. "Model organisms like these play a critical role in developing tools and ideas."

The first paper, published Oct. 1 in the journal Genetics, reports the genomes of 37 strains of Drosophila collected in Raleigh, N.C., and six strains from the sub-Saharan nation of Malawi. The other paper, to be published in Public Library of Science Genetics and currently available online as a preprint, describes the genomes of 139 fly strains covering 22 African and one European population.

Drosophila melanogaster, like humans, originated in Africa, and that's where they show the most genetic diversity ? just as humans do. The flies are thought to have appeared in Europe about 50,000 years ago, along with modern humans. On the way, both humans and flies squeezed through genetic bottlenecks that reduced the diversity in the population. Over generations, different fly strains evolved quite specialized niches ? such as a fondness for colonizing breweries, for example.

But the African fly genomes show that just in the past couple of decades, flies similar to those found in Europe or the U.S. have established populations back in Africa, often in new environments such as urban and industrial developments. For example, where modern breweries and bottled beer have displaced traditional African brewing, "Europeanized" brewery flies have followed.

The spread of those "European" genes is more rapid than if it were occurring by random processes, the researchers write.

"It may be that urbanization and development favor the more 'European' flies," Langley said.

How to Find and Attract an Agent and Publisher | Write Nonfiction ...

Any aspiring author who has ever wanted to become a traditionally published author asks two important questions: How do I find a literary agent and how do I attract a literary agent and publisher to my work? It?s not enough to just get a list of agents and start contacting them. You need to find an agent appropriate for the types of books you write and with whom you can develop a good working relationship. Even if you randomly select a few to query?or you do so in a more selective manner?and a few contact you in return, you must have a project they find interesting and the necessary elements to make them want to take you on as a client. An agent needs a writer to be a good business partner, as does a publisher. Since agents work on a commission basis and make no money unless a book gets sold, you must have a convincing argument that you not only have more than one great book idea in your head but that you can write it and help sell it.

The place to go to find an agent continues to be the 2013 Guide to Literary Agents. Edited by Chuck Sambuchino, it provides not only a listing of agents but invaluable information about what you need to gain literary representation. Once again this year, Chuck has turned out a new edition I would call THE resource for every aspiring author wanting a traditional publishing deal. Not only does it offer an updated list of agents, it also highlights new agents eager to have writers contact them. Plus, this edition offers information on how to assess the credibility of an agent (an issue for many writers with no frame of reference for agents they contact), what an agent can do for you (as told by actual authors), how to get your foot in an agency door, how to contact agents (with great examples of queries and proposals), conferences to attend, the memoir market, and creating an author platform. I loved the easily digestible and large number of FAQs provided and the stories of debut authors and their agents. You also get access to an online agent data base. Overall, I?d call the 2013 Guide to Literary Agents, not just a how-to-find-an-agent guide but a how-to-get-published guide.

Having said that, I?m pleased today to have Chuck answer a few questions about the role of literary agents and how to find and attract an agent and a publisher. This interview contains great information not necessarily found in his book .

As the publishing industry continues to change, how do you see the role of literary agents changing?

A few things come to mind.

In the last 5 years, we?ve seen advances toward debut and midlist authors trending down. The first reaction of agents was to do everything they could to maximize any subsidiary rights ? be those foreign language sales or audio rights or film rights, etc. So agents are trying to continue to make a living even though the book advance money being offered is not as good as it was a decade ago.

Also, since a lot of editors were laid off in the past few years, those that remain have less time to edit. That means we?ve seen some agents take on a more editorial role with their clients, because submissions and proposals, now more than ever, have to be pretty darn awesome before you send them for consideration.

Lastly, I?d say that agents are taking a close look at a writer?s platform when considering them as a client. Platform is your visibility as a writer and your ability to effectively self-market yourself and sell books. In other words, platform = money. If a writer has platform, that makes them more valuable, and agents want valuable clients so they can sell books. For years now, nonfiction authors have needed platform to get agents? and editors? attention. Now more than ever, a writer?s platform is under intense scrutiny.

Have any changes in the industry affected how aspiring authors need to approach agents? If so, what advice would you offer on how to do so?

This kind of touches on my last answer: Writers need an excellent proposal submission. In your proposal, you must quickly explain what the reader will get out of your book and why it is important, unique and timely. None of this is easy to do. Then after you?ve talked a bit about how your book is great and needed, you have to make an outstanding, airtight case as to why you can sell lots of books.

What 1-2 things does a writer need to do in a query or include that will increase the chances of an agent asking to see a book proposal?

1. Professionalism. Especially when considering a nonfiction author, the agent wants to quickly be assured that they?re dealing with a professional, competent business pro.

2. Hit all the major beats. Essentially, when you want to write a nonfiction book, you will end up discussing many elements about it (concept, layout, comparative titles, marketing, etc.) through a book proposal, which will run you 10-25 pages, not including the sample chapters. Then your next challenge is to boil down the best parts of the proposal into the proposal?s overview, which is 2-3 pages. But then you have to boil down the very best beats into the one-page query. So even though the query is only one page, it still has to touch upon all the major beats ? concept, timeliness, endorsements, comparable titles, platform, etc.

What tips do you have for those aspiring authors pitching agents in person? (Do you have a proven formula for pitching?)

I could speak for 90 minutes on the topic of the in-person pitching and sometimes do at writers? conferences around the country. But let me just say this: When you?re pitching an agent in person, you?re essentially just reading your query letter out loud in a conversational manner. So the principles of pitching and query writing are very much the same. That said, let me give one tip concerning pitching nonfiction in person. Since platform is so important, I?d suggest starting the pitch by telling a little about yourself (?I have a local radio show?) and THEN delving into what the book is about, before returning to expound on your platform once more.

And since platform is such a specific matter, with so many statistics and bullet points, feel free to bring a one-sheet about yourself that you place in front of the agent that they can review as you talk. People always ask me, ?Can I give materials to the agent to take with them?? The answer is no. But you can certainly put something in front of them for their visual review as they talk. They may even take it with them, but don?t expect that, and remove it from the table when you leave unless the agent really takes it.

Can nonfiction authors land deals with agents (or publishers) if they don?t have author platform? If so, how?

This is an interesting question, and one I tried to tackle a bit in my upcoming book, CREATE YOUR WRITER PLATFORM (Writer?s Digest Books, Nov. 2012), because I understand that people are looking for side doors to getting published. This is because most effective platforms take years to develop.

If your book subject is very timely, there is a chance that an editor would buy it, because sales are almost guaranteed. Also, if a writer has a great topic but no platform, why not try to co-write the book with someone who does have platform? The first writer does almost all of the writing, and the second does almost all of the promotion. That works. Lastly, a simple way to see your book sell is to have friends in the right places ? i.e., the media. I?ve seen many journalists that don?t even have a Twitter account let alone a comprehensive platform. This is because they have lots of journalist and reviewer friends in the media who will give the book nice press upon its release. Lucky skunks.

What 3-5 things should aspiring authors focus on to build the kind of platform that will impress an agent or publisher? And how big does that platform need to be?

If I had to pick three, I?d say 1) a blog or website as a home base of operations where people can come for content, 2) a Twitter account to help spread the word and connect with new readers through social media, and 3) some sort of other large way that you can connect with readers. This third way can be writing a newspaper column, being a contributor to a radio or TV show, or public speaking. So with #1, you have a home base for content and book selling; with #2, you reach out to people using the Internet; and with #3, you reach out to people in a way different from the usual social media tactics.

And concerning the question of ?How much is enough??, this is difficult to answer because it depends on your niche and what kind of book you?re writing. So the answer is different for everyone. But here is a general tip: If you think your platform may not be good enough, that?s a sign that you are not only 1 step away from where you want to be, but actually 2-4. When you finally submit, you should have no doubt that your platform is good and you can sell 1,000-3,000 copies of your book through the channels you currently have in place.

One of the largest U.S. consumer reporting agencies, Equifax Information Services LLC, has agreed to settle Federal Trade Commission charges that it improperly sold lists of consumers who were late on their mortgage payments.? In two separate actions, both Equifax and the companies that allegedly bought and resold the information from it will pay a total of nearly $1.6 million to resolve charges that they violated the FTC Act and the Fair Credit Reporting Act (FCRA).

The two settlements are part of the FTC?s ongoing efforts to protect consumers in financial distress and to protect consumer privacy.? Equifax will pay $393,000 to resolve allegations that its inadequate procedures led to the sale of lists of consumer information to firms that should not have received them.? According to the FTC, Equifax sold more than 17,000 prescreened lists of consumers to companies including Direct Lending Source, Inc., which subsequently resold some lists to third parties, who used their data to pitch loan modification and debt relief services to people in financial distress.

As part of a separate settlement, Direct Lending Source will pay a $1.2 million civil penalty,and will be barred from using or selling prescreened lists without a permissible purpose, or in connection with solicitations for debt relief or mortgage assistance relief products or services.

The FTC?s Complaints

The FTC alleged that between January 2008 and early 2010, Equifax sold Direct Lending and its affiliates lists of people who met selected criteria ? known as prescreened lists.? According to the agency?s complaint, the lists contained information about millions of consumers, including sensitive information such as credit scores and whether they were 30, 60, or 90 days late on their mortgage payments.

According to the FTC, neither Direct Lending nor its affiliates, Bailey & Associates Advertising, Inc. and Virtual Lending Source, LLC, had a legally permissible purpose to obtain the prescreened lists.? Under the FCRA, the only permissible purpose for obtaining a prescreened list is to make ?firm offers of credit or insurance? ? which are offers that will be honored if consumers meet pre-selected criteria.? Using a prescreened list for general marketing purposes is not allowed.? The FTC charged that Direct Lending sold the information to third parties that then used it to market products to consumers in financial distress, including companies that have been the subject of law enforcement investigations.

The FTC alleged that, in addition to providing the lists to entities without a permissible purpose and having inadequate procedures to prevent this from happening, Equifax failed to properly investigate when it learned Direct Lending was violating Equifax?s internal policies on prescreening.? The FTC also alleged that Equifax knew or should have known that in many cases Direct Lending resold the lists without telling Equifax who would end up using the information.? Despite these failures, the FTC alleged Equifax continued selling prescreened lists to Direct Lending.? The FTC alleged that Equifax?s failure to employ appropriate measures to control access to sensitive consumer information was unfair, in violation of Section 5 of the FTC Act.

Direct Lending and its affiliates and principals allegedly violated the FTC Act and the FCRA by:? 1) obtaining prescreened lists without having a permissible purpose; 2) reselling the reports without disclosing to the consumer reporting agency that provided them who the end users would be; 3) failing to maintain reasonable procedures to ensure that prospective users had a permissible purpose to get them; 4) to the extent that firm offers of credit were made, failing to maintain a record of the criteria used to select consumers for these offers; and 5) failing to employ appropriate measures to control access to sensitive consumer financial information.

The Proposed Equifax Settlement

In addition to requiring the payment of $393,000, the proposed settlement with Equifax prohibits the company from:

  • furnishing prescreened lists to anyone that it does not have reason to believe has a permissible purpose to receive them;
  • failing to maintain reasonable procedures to limit the furnishing of prescreened lists to anyone except those who have a permissible purpose to receive them; and
  • selling prescreened lists in connection with offers for debt relief products or services and mortgage assistance relief products and services, when advance fees are charged, with limited exceptions.

The Direct Lending Settlement

The court order settling the FTC?s charges against the Direct Lending defendants imposes a $1.2 million civil penalty and prohibits them from:

  • using or obtaining consumer reports without a permissible purpose;
  • using or selling consumer reports in connection with solicitations for debt relief or mortgage assistance relief products or services offered by entities that charge advance fees;
  • failing to disclose to the consumer reporting agency that originally furnishes the report the identity of the end user of the report, and each permissible purpose for which the report is being provided to an end user; and
  • failing to establish and comply with reasonable procedures designed to ensure that a report is resold only for a purpose for which it has been furnished.

The Commission vote to approve the consent agreement package containing the proposed settlement order with Equifax was 5-0.? The FTC will publish a description of the consent agreement package in the Federal Register shortly.? The agreement will be subject to public comment for 30 days, until November 9, 2012, after which the Commission will decide whether to make the proposed consent order final.

Interested parties can submit written comments on the proposed Equifax settlement order electronically or in paper form by following the instructions in the ?Invitation To Comment? part of the ?Supplementary Information? section.

Federal Trade Commission, Office of the Secretary, Room H-113 (Annex D), 600 Pennsylvania Avenue, N.W., Washington, DC 20580.? The Commission vote to approve the settlement order against the Direct Lending defendants and refer the case to the Department of Justice for filing was 5-0.? The complaint was filed by Department of Justice on October 9, 2012, in the U.S. District Court for the Southern District of California.? The settlement will become final when signed by the judge, and is not subject to public comment.

The Direct Lending defendants include Direct Lending Source, Inc.; Bailey & Associates Advertising, Inc.; Virtual Lending Source, LLC; Robert M. Bailey, Jr., individually and as an officer of the corporate defendants; and Linda Giordano, individually and as an officer of the corporate defendants.
